NetworkTuna End User License Agreement (EULA)

This EULA governs NetworkTuna (the “Software”). Installing or using it means you accept it.

1) License Grant

  • DeinitLabs s.r.o. grants a non-exclusive, non-sublicensable license for lawful personal or business use.
  • A paid license is purchased with a one-time payment. It is perpetual, never expires, has no recurring subscription or renewal fee, and includes all features of the NetworkTuna desktop Software.
  • The license includes all future NetworkTuna desktop Software versions and upgrades, including major versions, without an additional license fee.
  • This promise does not require DeinitLabs s.r.o. to create new feature releases or provide support or compatibility indefinitely, and it does not limit any updates or remedies required by law.
  • Separately identified optional hosted or third-party services are not part of the desktop license and may have separate terms or fees.
  • One license permits use on one computer at a time. You may move it to another computer after stopping use and removing it from the previous computer.

2) Trial

  • NetworkTuna may offer a trial for up to 28 consecutive days from first activation. A trial is not guaranteed.
  • It may be denied or shortened if installation or licensing records, or existing, imported, or restored NetworkTuna data, reasonably indicate earlier use. Reinstalling or restoring/importing data does not restart it.
  • After the trial, a paid license is required; otherwise, you must stop using and uninstall the Software.

3) Refund Guarantee

  • For a paid NetworkTuna purchase made through Paddle, you may request a full refund for any reason within 28 calendar days after the purchase date, using the refund option or support link provided by Paddle.
  • If a refund is issued, the refunded license terminates and you must stop using and uninstall the Software.
  • This voluntary guarantee does not limit mandatory rights or remedies. If applicable law or Paddle's applicable buyer terms or refund policy provides a longer period or additional refund, withdrawal, conformity, or other consumer rights, those more favorable rights also apply.
  • A refund may be denied in cases of fraud or refund abuse, to the extent permitted by law.

4) Ownership and Transfer

  • The Software is licensed, not sold. DeinitLabs s.r.o. and its licensors retain all rights.
  • You may transfer a license with DeinitLabs s.r.o.'s written permission or where law permits. You must stop using the Software, remove retained copies, and ensure the recipient accepts this EULA.

5) Restrictions

  • You may not circumvent trial or license enforcement, distribute or sublicense the Software without permission, or remove proprietary notices.
  • You may not reverse engineer, decompile, or disassemble the Software except where law expressly permits it, including statutory interoperability, backup, observation, study, or testing rights.
  • Use NetworkTuna only on computers and networks you own or are authorized to administer or monitor, and only for lawful purposes.

6) Network and Security Functions

  • NetworkTuna inspects, records, classifies, and may control network activity. Findings may be inaccurate, harmful activity may be missed, and legitimate traffic may be blocked. It does not guarantee security.
  • You are responsible for configuration and firewall decisions, backups and recovery access, and deciding whether NetworkTuna suits your environment.

7) Privacy and Bundled Components

  • NetworkTuna respects your privacy: except for a problem report you explicitly request and confirm as described below, traffic, security, usage, and configuration data remains on your computer. We do not sell it or use it for advertising.
  • We handle only personal information needed for a license or account, such as your email address and license status.
  • Product-improvement data will not leave your computer without a clear explanation and explicit opt-in consent. It must be anonymous, used only to improve NetworkTuna, and never shared.
  • If you ask NetworkTuna to send a problem report, it will first show what will be included and explain that logs, settings, and small minidumps may contain personal or sensitive diagnostic data. Nothing is uploaded until you confirm. We use the report only to investigate the reported problem, limit access to authorized staff, delete the server copy as soon as the investigation is complete, and schedule automatic deletion 21 days after receipt.
  • NetworkTuna does not install hidden, undisclosed, or unrelated software. The installer may install the disclosed Microsoft Edge WebView2 Runtime for the interface, under Microsoft’s terms. Incorporated open-source components remain subject to their own licenses.

8) No Warranties

  • To the maximum extent permitted by law, the Software is provided “as is” and “as available,” without voluntary warranties. DeinitLabs s.r.o. does not warrant uninterrupted or error-free operation, universal compatibility, or effectiveness against every threat. Non-excludable statutory rights remain.
  • Nothing in this section or Section 9 limits mandatory consumer rights, including statutory rights concerning conformity, required updates, and remedies.

9) Limitation of Liability

  • To the maximum extent permitted by law, DeinitLabs s.r.o. is not liable for indirect, incidental, special, or consequential loss, including lost profits, revenue, data, or business interruption.
  • Aggregate liability for direct damages is limited to the price paid for the affected license. This does not limit liability for fraud, intentional or grossly negligent conduct, death or personal injury, or any liability law does not allow to be limited.

10) Termination

  • This EULA terminates if you materially breach it. You must then stop using and uninstall the Software. Terms that should survive remain effective.

11) General

  • Czech law governs this EULA. Consumers retain mandatory protections provided by the law of their habitual residence. Courts have jurisdiction as determined by applicable law.
  • This EULA, together with the order confirmation and mandatory consumer information provided at purchase, governs the Software. If a provision is unenforceable, the remaining provisions stay effective. Failure to enforce is not a waiver.
